This section
deals with the terms and conditions relating to the online
sale of services provided by Vocal Process Limited to you.
From time to
time Vocal Process Limited may advertise services for sale by
third parties and other businesses on this website. Whilst
Vocal Process Limited try to ensure that any third party
offering services for sale through this website have the same
level of service as offered by us, you will be bound by any
third party’s terms and conditions should you choose to
purchase their service.
Vocal Process
Limited sells services to you subject to the terms and
conditions set out on this page.
1. Terms
and Conditions
1.1 By using
this website to apply for a place on a course you agree to be
legally bound with the relevant terms and conditions.
1.2 Using this
website to apply for place on a course confirms that you have
fully read and agree to be bound by these terms and conditions
and to the exclusion of any customers terms and conditions.
1.3 When you
place apply for a place on a course from this website, we will
send you an email confirming receipt of your application and
containing the details of your application.
1.4 Your
application represents an offer to us to purchase a place on a
course which is accepted by us when we send
e-mail confirmation to you that we have confirmed your place
on a course (the ‘Confirmation Email’). That acceptance will
be complete at the time we send the Confirmation Email to you.
1.4.1 Any
places on other courses on the same order which we have not
confirmed in a Confirmation Email to have confirmed your place
do not form part of that contract.
1.4.2 Any
products on the same order which we have not confirmed in a
Confirmation Email to have been dispatched do not form part of
that contract.
2.
Consumer’s Right to Cancel
2.1 Customers
in the European Union are entitled to a statutory cooling-off
period of seven business days. This is where the Consumer is a
consumer within the meaning of the Consumer Protection
(Distance Selling) Regulations 2000, the Consumer may cancel
the booking at any time up to the end of the seventh working
day (Monday to Friday) from the date on which the Customer
receives the Confirmation Email.
2.1.1 Vocal
Process Limited will make a full refund of any course fees
already paid provided notice is sent in writing during this
period to:

2.2 In all
other cases refunds for cancellations will be as set out in
section 11 below.
3. Order
Placement
3.1 Order
placement is strictly on these terms and conditions. Any order
on the Customer’s terms and conditions is only accepted by way
of convenience.
4. Pricing
and Availability
4.1 The
website lists services and courses for sale but this listing
is not indication of current availability. Courses may become
fully booked or withdrawn at any time.
4.2 As we
process your order, we will inform you by email if any service
you order turn out to be unavailable.
4.3 In the
event of a course being mispriced it is our policy that if a
course’s correct price is lower than our stated price, we will
charge the lower amount. If a course’s correct price is higher
than our stated price, we will, at our discretion, either
contact you for instructions before dispatch or cancel your
order and notify you of such cancellation.
5.
Liability
5.1 Vocal
Process Limited do not exclude or limit in any way liability
created by themselves or their employees or agents for death
or personal injury, which is unlawful to exclude or limit.
5.2 The
liability of Vocal Process Limited for other acts or defaults
whether by themselves, their employees or, agents whether in
contract, tort (including negligence) misrepresentation
(unless fraudulent) or other legal liability is limited to:
5.2.1 For
physical loss or damage to property: the amount per claim
which Vocal Process Limited is insured for under its public
liability policy(s)
5.2.2 For all
other liability: the amount of the course fee paid.
5.3 Under no
circumstances whatsoever shall any liability accrue for:
5.3.1 Any loss
of profits or revenue, loss of goodwill or third parties
liability or
5.3.2
Consequential loss
5.4 Where the
Customer is a consumer within the meaning of the Sale of Goods
Act 1979 or the Supply of Goods and Services Act 1982 then
nothing in these conditions shall be taken as depriving him of
any rights thereunder which it is unlawful to exclude.
6. Language
6.1 All
courses assume that attendees have a good command of the
English language.
7.
Copyright
7.1 All
materials supplied by Vocal Process Limited are the copyright
or other intellectual property of Vocal Process Limited
respectively and/or third parties as the case maybe.
7.1.1
Reproduction of any kind is not permitted without the express
written consent of Limited and/or third parties as the case
maybe.
8.
Non-attendance
8.1 If an
attendee fails to attend for any reason then the full course
fee remains payable.
9. Law and
Courts
9.1 English
Law governs the control and the English courts shall have a
non-exclusive jurisdiction.
10. Third
Party Rights
10.1 No third
party is intended to acquire rights under the Contract (Rights
of Third Parties) Act 1999.
11.
Cancellation
11.1 In the
event of the Customer cancelling then the course fee shall be
refunded as follows:

11.2 If for
any reason Vocal Process Limited cancels the course then the
course fee shall be refunded in full and no further liability
shall attach to Vocal Process Limited in respect of such
cancellation.
11.3 Vocal
Process Limited will use all reasonable efforts to provide the
course on the agreed date. If for any reason Vocal Process
Limited needs to change this due to circumstances beyond its
reasonable control such as, but not limited to, unavailability
of course tutors due to illness, inclement weather, strikes,
transport difficulties, then Vocal Process Limited shall
endeavour to re-arrange the course. The provision shall not
prejudice the Customer’s right to cancel the booking and be
refunded the fees in full and no further liability shall
attach to Vocal Process Limited in respect of such
cancellation.
12.
Interpretation
12.1 Words
denoting the singular number shall include the plural number
and vice versa and words denoting the masculine gender shall
include the feminine gender and vice versa.
12.2 Any
reference to any statute and/or regulation shall be deemed to
include a reference to all and every statutory amendment
modification re-enactment and extension in force on or after
the date of the Agreement.
13. Other
Businesses
13.1 Vocal
Process Limited is not responsible for examining or
evaluating, and we do not warrant or endorse the offerings of
any of other businesses or individuals, or the content of
their websites.
13.2 Vocal
Process Limited do not assume any responsibility or liability
for the actions, products, content and services of any of
these and any other third-parties.
13.3 You can
tell when a third-party is involved in your transactions, and
we may share customer information related to those
transactions with that third-party. It is your responsibility
to carefully review their privacy statements and other
conditions of use.
14.
Electronic Communications
14.1 When you
visit the website or send emails to us, you are communicating
with us electronically. We communicate with you by email or by
posting notices on the website. For contractual purposes, you
consent to receive communications from us electronically and
you agree that all agreements, notices, disclosures and other
communications that we provide to you electronically satisfy
any legal requirement that such communications be in writing.
This condition does not affect your statutory rights.
15. Alteration
of Service or Amendments to the Conditions
15.1 Vocal
Process Limited reserve the right to make changes to this
website, their policies, and these Terms and Conditions of
Sale at any time.
15.2 You will
be subject to the policies and Terms and Conditions of Sale in
force at the time of using the website to place your order for
services from us, unless any change to those policies or these
conditions is required to be made by law or government
authority (in which case it will apply to orders previously
placed by you).
